So the only thing we can do is ban by email, as bans by IP is almost pointless as well as host name right? The question becomes is Nobis Tech Group ultimately responsible and liable? Their website kinda says it all http://www.nobistech.net/
So my question to you all is what should be done or can be done?

I always include banning by email address.  It seems that spammers use the same emails over and over.  If a legit email gets sucked into spamspace and banned, I figure the person can privately email me and get it fixed.

Most ISP's have channels you can go through to report abuse.

My advise:
1. More information is better (copies of logs with timestamps, description of violation, a direct quote and link to their terms of service page that says users cannot do this)
2. Show them that not taking action is having a negative effect on their reputation. (link to this site and others ESPECIALLY is they name the ISP as being spam friendly as in this link: http://hostjury.com/reviews/1and1 - search for the word "spam")
3. Be polite about it.
4. Don't let them ignore you, if you don't hear a reply within a couple weeks, send the email again (retype a brand new email so there's no doubt you're not just copy/paste spamming them)

hmm - that domain is registered through domains by proxy, you're probably out of luck unless you want to get a lawyer. =(

GoDaddy really really dont care about spammers.  they make a lot of money from them.  On the other hand, register a site through them and put a website on it saying that some Labout MP is stealing and GoDaddy will rip your site down so fast that youll pants will fall off.

GoDaddy's offices are probably 45 minutes away from my house - I've always wondered how well a complaint in person would be received...

Bring a camcorder, and put the video on YouTube,
THAT will get their attention .

Their office is probably an empty building with a PBX forwarding calls to Moscow.

Just kidding, but it wouldn't surprise me either.

P.S. They are bound to take you more seriously if you have a huge pair of dikes (large wire cutters) sticking out of your back jeans pocket. ahahahahahaha

Re: What to do and how proactive can we get?

I have banned their entire blocks. Nothing but spam from them, and as they are a server farm (NOT AN ISP) there should be NO traffic to blogs or galleries from their blocks.

.htacces:

<Files 403.shtml>
order allow,deny
allow from all
</Files>

# Nobis/Ubiquity
deny from 64.120.0.0/17
deny from 69.147.224.0/19
deny from 173.208.0.0/17
deny from 173.234.0.0/16
deny from 174.34.128.0/18

I have found that complaints to their abuse address come with a standard reply - "We've told our customer to stop", or, in other words, they're not going to take action against a revenue stream, even if it's against their ToS

Time for them to be blacklisted by Spamhaus, methinks

It should be legal to carry an RPG in the car to blast the idiots doing 80km/h in the passing lane out of the way. The same is true for spammers.
